The meeting was called to order at 6:30 pm by Mayor Straney and the salute to the flag was given.

In recognition that many members of the public were in attendance for the presentation pertaining to the Nestle / Blue Triton study of the Village watershed, the presentation scheduled under "New Business" by Michael Palleschi of AIph GeoScience, and Kent Koptiuch of KSK Geo-Environmental, was moved to the to the first order of business. Members of the public addressed questions regarding the study to the Mayor, Village Board, and Mr. Palleschi and Mr. Koptiuch. After approximately one- and one-half hours of questions the presentation concluded, and the Board Meeting returned to the established agenda.

Blue Triton expressed their interest in continuing the study. Department Heads:

Fire Department: Fire Chief Shannon Countryman discussed the bathroom odor situation with the Board. Reports submitted.

DPW: No one present. Report submitted.

WWTP: No one present. Report submitted.

Police: Police Chief Donald VanDeusen discussed cameras with the Board. He also stated Herkimer Police Department helped us locate ammunition to buy. Report submitted.

A motion was made by Trustee Grant and seconded by Trustee Castrucci to accept Resolution #18 of 2021 regarding the contract with the Town of St. Johnsville for Fire Protection. All ayes, motion carried.

A motion was made by Trustee Grant and seconded by Trustee Castrucci to accept Resolution #19 of 2021 regarding the contract with the Town of Palatine for Fire Protection. All ayes, motion carried.

A motion was made by Trustee Grant and seconded by Trustee Castrucci to accept Resolution #20 of 2021 regarding the contract with East Canada Creek Fire District for Fire Protection. All ayes, motion carried.

Mayor Straney shared the Village had been awarded a $35,000.00 CDBG grant for the study of the Village Water System. The work considered will be undertaken by Delaware Engineering who assisted the Village in obtaining the grant.

Consent Agenda: A motion to create a consent agenda consisting of the minutes of the 11/16/21 Regular Meeting, DPW, WWTP, Police, Codes and Treasurer's reports was made by Trustee Grant and seconded by Trustee Buckley. All ayes, motion carried.

A motion to adopt said Agenda was made by Trustee Castrucci and seconded by Trustee Buckley. All ayes, motion carried.

Audit of Claims: A motion to accept the claims as presented to the Board as approved to the Board by the Clerk, in the amount of $257,525.74 was made by Trustee Grant and seconded by Trustee Castrucci. All ayes, motion carried.

The claims are broken down as follows:

A motion was made by Trustee Grant and seconded by Trustee Buckley to go into executive session to discuss police department personnel at 8:45. All ayes, motion carried.

A motion was made by Trustee Grant and seconded by Trustee Buckley to come out of executive session at 9:00. All ayes, motion carried.

A motion was made by Trustee Grant and seconded by Trustee Castrucci to increase police officer wages to $21.00 per hour effective 1/1/22. All ayes, motion carried.

A motion was made to adjourn at 9:04 PM by Trustee Castrucci and seconded by Trustee Grant. All ayes, motion carried.

The meeting was called to order at 6:30 pm by Mayor Straney and the salute to the flag was given.

Department Heads:

Fire Department: Fire Chief Shannon Countryman discussed the hose testing with the Board. Reports submitted.

DPW: DPW Superintendent Jarrod Walrath is keeping the cemetery open until the first substantial snowfall. Yard debris will be picked up until November 30th Report submitted.

WWTP: Report submitted.

Police: Police Chief Donald Van Deusen was pleased to report the SRO officers have their active shooter training for new employees at the JR/SR High School and Elementary School completed, as well as annual employee evaluations. Report submitted.

Treasurer: A motion was made by Trustee Grant and seconded by Trustee Dockerty to open a CD in the amount of $25,203.37. All ayes, motion carried. A motion was made by Trustee Grant and seconded by Trustee Dockerty to approve pre-payments of Spectrum bills. All ayes, motion carried.

Legal: Village Attorney Norman Mastromoro discussed the ongoing tax proceedings with the Watershed property values with the Mayor and Board.

Old Business:

A motion to adopt Local Law #4 of 2021, a Local Law amending Section 87-4 of the Village Code regarding dog leash and walking and cleanup requirements for enactment as revised and approved on October 19, 2021, but excluding proposed Section E number of allowable dogs in its entirety. All ayes, motion carried.

New Business:

A motion was made by Trustee Grant and seconded by Trustee Dockerty to accept the Contract of snow and Ice removal from Montgomery County as presented. All ayes, motion carried.

A motion was made by Trustee Grant and seconded by Trustee Buckley to obtain a .gov for the Village the name for which is to be determined. All ayes, motion carried.

A motion was made by Trustee Grant and seconded by Trustee Dockerty to accept Resolution #16 of 2021 regarding the bonding for the Ladder Truck and Backhoe. All ayes, motion carried.

A motion was made by Trustee Buckley and seconded by Trustee Dockerty to approve Resolution #17 of 2021 for the Fire Contract with the Town of Palatine starting January 1, 2022, through December 31, 2023. All ayes, motion carried.

A motion was made by Trustee Buckley and seconded by Trustee Dockerty that in the event Blue Trident decides not to proceed with the Village that the current infrastructure will stay installed. All ayes, motion carried.

Discussion from Mary Beth Bianconi and Peter Martin of Delaware Engineering ensued. A motion was made by Trustee Dockerty and seconded by Trustee Buckley to approve the SEQR process presented. All ayes, motion carried.

Consent Agenda: A motion to create a consent agenda consisting of the minutes of the 10/19/21 Regular Meeting, DPW, WWTP, Police, Codes and Treasurer's reports was made by Trustee Grant and seconded by Trustee Dockerty. All ayes, motion carried.

A motion to adopt said Agenda was made by Trustee Grant and seconded by Trustee Buckley. All ayes, motion carried.

Audit of Claims: A motion to accept the claims as presented to the Board as approved to the Board by the Clerk, in the amount of $90,663.23 was made by Trustee Dockerty and seconded by Trustee Buckley. All ayes, motion carried. The claims are broken down as follows:

The meeting was called to order at 6:30 pm by Mayor Straney and the salute to the flag was given.

Department Heads:

Fire Department: Fire Chief Shannon Countryman and Mayor Straney discussed the replacement vehicle for Tower 1. The Village is in the process of receiving a $250,000.00 bond for the Fire Truck. The new ladder truck out of Long Island is $135,000.00. Reports submitted.

DPW: DPW Superintendent Jarrod Walrath reported the well is back up and running on automatic operation. It is his suggestion to purchase a second new well motor to have on standby in the event the motor fails again. Report submitted.

WWTP: Mayor Straney discussed the progress being made with Delaware Engineering. Mayor Straney was able to get the SPEDES permit lowered from $8,000.00 to $2,000.00. Report submitted.

Police: Police Chief Donald Van Deusen was pleased to report the successful training day the Police Officer's held October 2, 2021. They now meet or exceed all training requirements expected from the state. Report submitted.

Marina: Mayor Straney stated the Marina! Campground is closed for the season, the flood plain is clear, and Joe Francisco would like to return as Harbor Master in the upcoming year.

Treasurer: Village Clerk! Treasurer stated the Bank Reconciliations are all current as of September 30, 2021. Reports submitted.

Public: Nino Polidori, Anthony Possemato, and Cassandra Allen discussed the Dog Law with the Board and Mayor.

Old Business:

A motion to adopt proposed Local Law #4 of 2021 for 4 dogs, 6' non-retractable leash, and a walking age of 15 years old was made by Trustee Castrucci and seconded by Trustee Buckley. All ayes, motion carried. HOW TO ADDRESS IF GOING TO NOV MEETING

The Board decided to go with the purchase of the new Pitney Bowes machine. New Business:

A motion was made by Trustee Castrucci and seconded by Trustee Buckley to give a one-time waiver of Stephen Penge's sewer excess portion on his combined utility bill due to the leak he had in his basement from a broken pipe. All ayes, motion carried.

Mayor Straney informed Police Chief Donald VanDuesen that the new regulations pertaining to Psychological Evaluations for new Officer's will be paid as they occur, then a transfer will be made from the General Fund to the Police Budget if needed.

A motion was made by Trustee Grant and seconded by Trustee Buckley to approve Resolution #11 of 2021 to collapse WIIA and SRF Financing Project C4-5438-02-00. All ayes, motion carried.

A motion was made by Trustee Castrucci and seconded by Trustee Grant to approve Resolution #12 of 2021 for the intent to declare SEQR Lead Agency Comprehensive Wastewater Treatment Plant Upgrade. All ayes, motion carried.

DPW Superintendent Jarrod Walrath located a backhoe for $106,000.00. Fire Chief Shannon Countryman located a Tower truck for $135,000.00. Both vehicles come under the amount of their approved bonds.

A motion was made by Trustee Grant and seconded by Trustee Castrucci to approve Resolution #13 of 2021 to accept donated services for the Grand Stand at Soldiers and Sailors Park being given by the Friends of St. Johnsville to hire Claus Construction and TW Services. All ayes, motion carried.

Peter Martin and Mary Beth Bianconi of Delaware Engineering spoke to the residents and Board about the anticipated project at the Waste Water Treatment Plant.

A motion was made by Trustee Grant and seconded by Trustee Castrucci to approve the payment of $35,000.00 from the OESJ School for their water/sewer bill associated with the DH Robbins School.

Local Law #4 of 2021

A large discussion occurred regarding the age requirements to walk a dog while maintaining control of the dog, as well as the number of dogs allowed per parcel. The majority of the public agreed with the 6' leash length and cleaning up feces when being walked.

A motion to end the Public Hearing at 7:24 PM was made by Trustee Dockerty and seconded by Trustee Grant. All ayes, motion carried.

Fire Department: Fire Chief Shannon Countryman stated the 9/11 memorial ceremony went well. The Fire Department members will be having their OSHA and EVOC courses on Saturday. The hoses will be undergoing their testing. Report submitted.

DPW: DPW Superintendent Jarrod Walrath discussed the stump grinding that will take place at the Cemetery over the fall. Jarrod stated that the Village should sell the SCUBA van. The streams at the Park were cleaned out, street signs replaced, and the street sweeper is fixed. Report submitted.

WWTP: The process with Delaware Engineering has begun. Report submitted.

Police: Police Chief Donald Van Deusen informed the Board of new state regulations pertaining to Police Officers. As of 10/16/21, psychological evaluations will be conducted in person with current, and any new officers. The Police Officers will be having a range day on 10/2/21 for their firearms, new Taser, use of force, and sexual harassment training. Report submitted.

DPW: DPW Superintendent Jarrod Walrath discussed the stump grinding that DPW did throughout the Village. There was a discussion of Monroe Street and National Grid poles. Jarrod stated that there have been 21 burials for the season at the cemetery so far. Report submitted.

WWTP: WWTP Supervisor Frank Erno discussed the wet testing. If the Village passes 4 tests for the year, then testing will go down to one per year. Report submitted.

A motion to adopt for enactment proposed Local Law #3 of 2021 with the amendment to 15 feet for all distances was made by Trustee Grant and seconded by Trustee Castrucci. All ayes, motion carried.

A motion to adopt proposed Local Law #4 of 2021 for 2 dogs and date of 8/17/21 for presentation at public hearing on 9/21/21 was made by Trustee Buckley and seconded by Trustee Grant. All ayes, motion carried.

The meeting was called to order at 6:30 pm by Mayor Straney and the salute to the flag was given.

There was a discussion regarding fire pit distance away from any structure.

There was a discussion of the number of dogs allowed per residence, renters, land lords, leases, licensing, leashes, and disposal sites of excrement.

Due to Covid-19, Nestle was not able to get the full year worth of reporting they had wished to gain.

Legal: Attorney Mastromoro discussed proposed Local Law's 3 and 4 of 2021.

Old Business:

Pool fills and top off's pricing was changed. The new pricing is the $.05 per cubic foot of water plus $22.50 per hour, per employee.

Mayor Straney discussed multiple aspects of the proposed CDBG Grant Request pertaining to the WWTP improvement project, including the installation of flood hardened RAS pumps, installation of bar screen building low flow screening equipment, harnessing of unused air capacity in sludge holding tanks to facilitate the continuation of the bacterial breakdown process, relocation, downsizing and updating of plants electrical switch gear to provide flood hardening and improve safety for operators, the possibility of variable speed drive SCADA ready pumps.

Fire Department: Chief Countryman discussed the 1989 tower truck, and the repair estimates she has requested to address the trucks operational deficiencies found during inspection. She stated that Engine 1 and Engine 3 both passed the safety inspections.

There was also a discussion with Chief Countryman and Police Chief VanDeusen regarding establishing fire pit rules and regulations within the Village. Report submitted.

Marina: No one present, no report. There are currently 9 Seasonal campers and 2 more interested. Mayor Straney discussed the present allocation of fuel tanks at the Marina and the breakdown of fuel sales Gas versus Diesel. Future sales will dictate fuel storage allocation. We continue to pursue the purchase of docks to replace those damaged in the November 1, 2019 flood. The existing docks require cooperation from the Canal Corp / Power Authority to facilitate their seasonal installation and removal, a process they have stated they will not perform. We are therefore investigating docks which Village Staff can install and remove seasonally independently.

Legal: Attorney Mastromoro discussed the ongoing tax proceedings with Oppenheim and Ephratah relative to the watershed and transmission piping.

Mayor Straney discussed the trees at the watershed. The Management Plan for the Watershed 900-acre woodlands should be updated. This was last done in 2010.

Chief Countryman also shared with the Board that they have had a great turn out for calls and the response time went from 12 minutes a few months ago, to under 2 minutes currently. Report submitted.

DPW: DPW Superintendent Jarrod Walrath stated that they will be using the street sweeper during the next few rainy days. The sweeper handles the wet roads better and it also causes less dust. The sweeper has been around the Village twice prior. Jarrod also stated that they have had 2 burials at the cemetery, and they have 9 more to do before May 15th Report submitted.

The Chamber of Commerce will not be having Springiest this year. The American Legion has begun the preparation for the Memorial Day Parade. The LWRP Grant which was used for the improvement of the Soldiers and Sailors Park wall was discussed. The Department of State has placed a contingent liability on the Village in the amount of $14,900 for failure to meet MWBE goals associated with this project. Future Grants offered to the Village will require an increase in the MWBE goal to address this shortfall. The Village Clerk will be contacting Weaver's Sanitation to set up Trash Days in June.

WWTP: No one present. No report. Mayor Straney discussed the quotes for new RAS pump at the WWTP. The pumps are original to the building of the plant in 1973.

Legals: Attorney Norman Mastromoro discussed Police disciplinary rules and confirming they are consistent. Follow-up on information relative to the Village not required to accept cash payments pursuant to an opinion request by Trustee Castrucci. The Flood Plain Law was received by the Secretary of State which was necessitated by a labeling error by the NYDEC..

The Public Health Emergency Plan is due by 4/1/21.

CBDG Public Hearing- A motion was made by Trustee Buckley and seconded by Trustee Castrucci to accept Resolution #3 of 2021 pertaining to the Intent to Apply for Community Development Block Grant in the amount of $50,000.00 for planning relative to the WWTP. All ayes, motion carried.

Consent Agenda: A motion to create a consent agenda consisting of the minutes of the 12/23/20 Regular Meeting, DPW, WWTP, Police, Codes and Treasurer's reports was made by Trustee Grant and seconded by Trustee Dockerty. All ayes, motion carried.

A motion to adopt said Agenda was made by Trustee Castrucci and seconded by Trustee Dockerty. All ayes, motion carried.

Audit of Claims: A motion to accept the claims as presented to the Board as approved to the Board by the Treasurer, in the amount of $173.594.96 was made by Trustee Grant and seconded by Trustee Dockerty. All ayes, motion carried. The claims are broken down as follows:

 General Fund: $128,727.72

Cemetery Fund: $0.00

Marina Fund: $2,082.50

Water Fund: $37,265.74

Sewer Fund: $5,519.00

A motion to adjourn the regular meeting and go into executive session to discuss litigation relative to employment and enforcement of codes was made at 7:48 PM by Trustee Grant and seconded by Trustee Dockerty. All ayes, motion carried.

A motion to come out of executive session and back into the regular meeting at 8:41 PM was made by Trustee Buckley and seconded by Trustee Dockerty. All ayes motion carried.

Motion to instruct Attorney Mastromoro to stop "Judicial Appeal" on litigation of unemployment claim was made by Trustee Castrucci and seconded by Trustee Grant. All ayes, motion carried.

The meeting was called to order by Mayor Straney and the salute to the flag was given. No one was present for public input.

Meeting was closed out at 6:26 PM relative to the correction of the Flood Plain Law listed in Local Law #1 of 2021.

The meeting was called to order at 6:30 pm by Mayor Straney and the salute to the flag was given.

Department Heads:

Fire Department: Mayor Straney discussed with the Board the vibration in Engine 1 potentially has been located and is not significant to the operation of the equipment. Shannon stated that the Fire Department needs to do ladder and hose testing. Discussion ensued. Report submitted.

DPW: There were 10 full burials and 10 cremations done at the Cemetery for the year. Jarrod presented some quotes to the Board regarding the budgeting for the purchase of a new backhoe. Report submitted.

WWTP: No one present. Report submitted.

Police: Chief VanDeusen discussed the Police Reform with the Board. The agreed to have a Public Meeting on February 17th at 6:30 PM via Gotomeeting. Clerk will prepare the necessary postings.

Codes: No one present. Report submitted.

Marina: No one present, no report. The Harbor Master House interior has been painted.

The Board needs to give thought to how we will proceed in the 2021 camping / boating season. Treasurer: The audit for the Fiscal Year ending 2019/2020 is almost complete. A motion was made by Trustee Dockerty and seconded by Trustee Grant to allow a transfer from the Water/Sewer account to the General fund in the amount of $14,371.00. This "Due To/Due From" was carried forward from previous fiscal years and will be reported in the 2019/2020 Audit. All ayes, motion carried. Reports submitted.

Resolution Friends of St. Johnsville- A motion was made by Trustee Castrucci and seconded by Trustee Dockerty to approve Resolution #1 of 2021 in support of pursuit by the Friends of St Johnsville of a Urban Forestry Grant. All ayes, motion carried.

Resolution Election - A motion was made by Trustee Grant and seconded by Trustee Dockery to approve Resolution #4 of 2021 regarding the March 16, 2021 election. All ayes, motion carried. FMLA- Concluded this legislation does apply to the Village operations and will be implemented. Spectrum- Board decided to go ahead with the transfer of phone lines from Frontier to

Spectrum at a saving to the Village.

CBDG Public Hearing- A motion was made by Trustee Buckley and seconded by Trustee Grant to hold a public hearing on February 16th at 6:15 PM regarding a Community Block Development Grant in the amount of $50,000.00 for planning relative to the WWTP. All ayes, motion carried.
