Planning Board -
December 07, 2017 The meeting was called to
order at 7 Pm by Chairman Mancini. Present were
Vice-Chairman George Haines, Melanie Shuster. Absent
Les Larsen and Code Enforcement Officer, James
Castrucci. From the Public Michael Mancini, John Regan
from Cypress Creek Solar Energy, Roger Lottman and
Peggy Nixon The minutes of November
were read and approved The Chairman's report was
read stating the leaving our Chairman Mancini on
January 1st as she will now be given a new position
on the Town Board. It was with regret that we heard
of this. In the past Martha Mancini was highly
organized and diligent in her work and extremely
informed at each meeting. Her greatest contribution
would have been Montgomery County adopting our Solar
Law as an example to other Townships. Now thanks to
the Planning Board a farmer can sell his land
without any problems. With our diligence we were
also able to stop any lawsuits in process to Mr.
Fitzpatrick. The Board functioned very well together
as appreciated by our Chairman. Mr. Ryan of Cypress Creek
thanked the Board for the appreciation and
helpfulness the Board has been to his Company. He
too, was impressed with the grasp found on this new
Solar Law by our entire Board. Mr. Regan brought the
Engineering maps for our inspection as our Chairman
will take this process to the County. The taxes
agreed upon was now moving forward with this Town.
Mr. Lottman talked about the 2 megawatt 91 1/2 acre
Solar Farm Property that was to be screened from the
road on Crum Creek Road with Cypress Creek
Renewables. Old Business Melanie Shuster attended
the Funeral Committal Service on behalf of Chairman
Mancini and the entire Town Planning Board for Paul
Flanders held at the Masonic Temple in St.
Johnsville thanking the family for all the many
years he served on the Planning Board with informed
and intelligent service helping to formulate the now
in use Comprehensive Plan we now have in use. Under Old Business: The
SEQR form was filled out for the proposed law and
given to the Town Board for approval or disapproval. Under New Business: A
discussion on the review of the Comprehensive Plan
for plans to update. Also a discussion of the
possible re-zoning of Matis Road properties which
led us into a review of the zoning maps of the Town
of St. Johnsville. Since there was no Public

Planning Board -
November 02, 2017 Meeting called to order at
7 P.M. by Chairman Martha Mancini. Present Chairman
Mancini, Vice Chairman George Haines, Les Larsen,
Melanie Shuster. Present from the Public, Michael
Mancini-- Absent Code Enforcement Officer, James
Castrucci THE MINUTES OF October 5,
2017 were read and approved. The Chairman's report
attending the meeting of the Town on October 12th
was now given by Martha Mancini. The Town Board
voted to repeal Law 66 in the land use Law, as the
Board felt this was unconstitutional as it would not
allow a -farmer or land owner to sell 'and upon
retiring or going out of business. The Town Board
unanimously acknowledged the Planning Boards
recommendation to repeal this law and set the public
hearing, which is required by the State of New York. A discussion was then held
due to the fact that many times vacancies are
available in the Town Government and no one wants to
fill these as they feel unappreciated or
discriminated against. This is a very sad situation
which should be addressed. THE Planning Board's
written request that we meet every two months has
been ignored by the Town Board. Motion to close the

Board -
October 05, 2017 Meeting called to order at 7:00
pm by Chairman Martha Mancini Present Chairman
Martha Mancini, Vice Chairman George Haines, Les Larsen, Secretary Melanie
Shuster. Absent Code Enforcement Officer James
Castrucci, Present from the Public Michael Mancini Motion to accept the minutes made
by Les Larsen, seconded by George Haines. Motion
accepted. The Town did not address the
motion that the Board would meet every two months
due to very little work load. The memo was sent in
plenty of time for us to have received an answer. Our Board has done everything
with the correct protocol, but when our Chairman
speaks to the Town Board she has not been given the
proper respect due to someone who has spent many,
many hours with no remuneration. Whenever she does
not have the answers she will then find a way to
research for information. For all of these reasons,
in the future she will not place herself in a
situation with the Town Board due to a lack of
respect, all communication that in the past were
verbal will have to be in a written form. In November we expect the
representative of the Cypress Solar Company to be in
attendance to bring us up to date on what is
happening locally with land in the Town. The Solar
Laws on the County level were copied from ours. George Haines made a motion and
seconded by Les Larsen to request $10,000 for budget
expenses. Passed by Board. No Public Comments, Motion to

Planning Board -
September 07,
2017 The meeting was called to order by
Chairman Martha Mancini at 7:05 pm. Present was Chairman Martha
Mancini, Vice Chairman George Haines, Les
Larsen, Melanie Shuster. Absent Code Enforcement Officer
James Castrucci. From the Public Michael Mancini. Minutes of Secretarial report read
and approved. Motion by George Haines to
accept, seconded by Les Larsen. The Chairman's report regarding the
change of Section 66 of the Land Use Law was
presented to the Town Board and decided by
them to repeal the section to change the
percentage of 10% to 100 % of farmland that
could be sold in parcels or otherwise. The
Town Board thought that our reasons for this
change was "good common sense." The
Supervisor decided to be in charge of the
questionnaire that will be sent to Town
Residents. What we presented was not
acceptable. The Solar Company that in the past
would have met with us will in the future
meet with the Supervisor. The opening of Jeff Hadcox
resignation was discussed as this is hard to
be replaced. The Town Board has this
decision also. Under New Business Melanie Shuster
suggested that since we have little or no
work we should meet every two months instead
of monthly. We also received a report from
the Code Enforcement Officer. Motion to close at 7:35 pm by Les

Johnsville Planning Board - August 3rd, 2017 Meeting called to order at 7:08 pm.

Shuster. Absent Jeff Hadcox, also Code
Enforcement Officer. From the Public Michael
Mancini The minutes of July 6th were read
and approved. Motion by George Haines,
seconded by Les Larsen. The Chairman's report was read
whereby she was told that the Planning Board
was not supposed to plan and the Board was
not to solicit new business. We have little
or no power according to the Supervisor. We
may also review any use permits that are
denied or are not permitted in the land use
law. We may be able to review the land use
laws and recommend changes. Melanie Shuster questioned whether
or not we should not have to revise the
Comprehensive Plan as that is also a plan,
and would be in contradiction to the Town
Board. Les Larsen asked why the Code
Enforcement Officer was not accountable to
the Board as he is a paid employee. Under New Business the Board
recommended that we change on page 66 the
Land Use laws thereby permitting a farmer to
sell all of their land and not the 10% as
mentioned in the Land Use Laws. This is not
an acceptable practice to a farmer as
written. A questionnaire is to be sent to the
residents of the Town requesting information on
what they would like to see happen in the
future. Motion to close by Les Larsen at 850 pm

Board - July 06, 2017 The meeting was called to
order at 7:00 PM with Martha Mancini,
Chairman, George Haines, Jeff Hadcox,
Melanie Shuster, Secretary, Michael Mancini,
Public were present. Absent Less Larson,
Code Enforcement Officer James Castrucci. Minutes of June 1st
planning board meeting were read and
approved. The Chairman, Martha
Mancini, gave her report about her attending
the Town Board meeting on June 8th where the
town supervisor told Chairman Mancini that
the planning board was not supposed to plan
and the planning board was not supposed to
solicit new businesses to come to St.
Johnsville. He said that the only thing the
planning board is supposed to do is review
the comprehensive plan and recommend changes
to it, and to review the land use laws and
recommend changes in them. And, also, we are
supposed to review any use permits that are
denied or are not permitted in the land use
laws. The planning board does
not have any power to do anything except
this according to Stagliano. The Planning Board
reviewed the Comprehensive Plan dated 2005
and discussed the following: 1. Page 35: Ensure proper
training of planning officials. 2. Page 36: Require Code
Enforcement Officer to attend all Planning
Board Meetings 3. Page 37: The Town
should revise and adopt new Land use Laws
and Subdivision regulations to comply with
the spirit of this comprehensive plan. 4. Page 37: Commit the
Town Planning Board to maintain this
Comprehensive Plan and to update it at
5-year intervals to keep it current. 5. Page 39: The Town
Board will need to delegate some
responsibility in implementing the plan.
Various citizen committees should be
depended upon for doing research and making
action recommendations to the Town Board.
The plan recommends the following committees
be formed:

suitability assessment (LESA) to identify
important open space and farmlands. Identify
scenic roads. Retain professional and volunteer
help as needed. C.
Draft and
adopt a local Right to Farm Law D.
Draft and
adopt a local law requiring training and
education of all planning and zoning officials,
including the zoning and code enforcement
officers. Budget for training expenses. E.
Research
grants that will help fund recommended economic
development, affordable housing, recreation and
administrative programs. F.
Begin
work on revising the Land Use Law. Draft
specific design standards. 8. Page 40: Medium Term: One
to Three Years 9. Page 41: Medium Term:
Three to Five Years 10. Page 41: Long Term: Five
to Fifteen or Twenty Years The Town Board has not
adopted any of the recommendations that were
made in the Comprehensive Plan dated 2005. Not
one single one. In further discussions,
Melanie Shuster wondered why the Town Board
seemed to be totally against the planning board
it seemed to her. She said that the Town Board
had been informed of every action that the
Planning Board had made every month. She said
that the Town Board had the opportunity to stop
the Planning Board since Sept. or Oct. of 2016
with regards to the supermarket search and did
not stop the Planning Board until June, 2017.
The Planning Board decided that this must have
been a political decision. She also said that
communication between all sections of the town
government should be paramount in order to make
the town successful. St. Johnsville Planning
Board - June 01, 2017 The meeting was
called to order at 7:05 PM with Martha Mancini,
Chairman, George Haines, Jeff Hadcock, Melanie
Shuster, Secretary, Michael Mancini, public present.
Absent Les Larson, Code Enforcement Officer James
Castrucci. Minutes of May 4th planning board meeting
were read and approved. The Chairman, Martha Mancini, gave her
report giving the secretary a copy of a letter she
wrote to the Town Board regarding their April 11th
meeting at which time a resolution #17-045 that was
passed by unanimous vote to write a letter to Martha
Mancini, Chairman of the Planning Board, forbidding
her in the name of the town or planning board to
participate in the discussion of dissolving the
Village of St. Johnsville. This resolution was made
based upon the Town Supervisor, Dominick Stagliano’s
recommendation after reading posts on the Internet
"gossip" and misinformation. This letter was
demanding a retraction and clearing of Martha
Mancini's name. Copy of letter attached to minutes. Old Business: The planning board was
presented with a copy of a building permit dated
February 28, 2017, permit 41-2017, to J. R. Auctions
permitting "redo septic system and add grease tank." Exceptions were placed upon this permit
that inspector needed to inspect plumbing before
enclosing and footing before backfill before final
inspection. The planning board was presented with a
copy of a Monthly Report for the month of March 2017
from Code Enforcement Officer. This report stated
that he did a town wide inspection up to 15-miles.
He also stated that he dropped off permit
application to Tracy Haak, Clay Hill, and Matt Cook
on Bavar Road to remove 2-old cars. The planning board discussed the dates on
this information from the Code Enforcement officer
calling attention to February 28, 2017 and March,
2017 and not notifying the planning board until
June, 2017. Since this present planning board was sworn
into office, the Code Enforcement Officer has
refused to attend a single meeting and to place a
copy of any building permit that was written in the
Planning Board mailbox as was requested and he
agreed to do. This is the first time the Planning
Board has received anything from the Code
Enforcement Officer, and we assume was sent by the
town clerk for him. New Business: There was no new business Public Comments: No public comments A motion by George Haines was made to
adjourn at 8:10 PM, seconded by Melanie Shuster.

Board Meeting Dear Mr. Stagliano: After reading the minutes of the
Town Board of April 11th when it was posted
on the internet, I would like to direct your
attention to "New Business" section #8: Planning Board -- discussion took
place regarding the petition being
circulated by Martha Mancini, Chairman of
the Planning Board for the Town of St.
Johnsville, attempting to dissolve the
Village through a referendum. The Town Board
feels that Martha is putting the town in a
bad position, and does not want it portrayed
that she is acting on behalf of the Town.
Motion by Councilman Smith, seconded by
Councilman Millington to authorize
Supervisor Stagliano to send a letter to
Martha Mancini expressing the Planning
Board's authority, and that they are not
representing the town in her quest to
dissolve the Village. (Res. #17-045) I did not nor have not received the
letter that this resolution stated. First of all, this section of the
minutes is not true. I did not and never
have circulated a petition for or against
the dissolving of the Village of St.
Johnsville. I am not campaigning for this. I
am not trying to dissolve the Village of St.
Johnsville through a referendum. I have
never placed the Town of Saint Johnsville in
a bad position. I have never used the
position of Chairman of the Planning Board
for the Town of Saint Johnsville in any
matter other than the limits that I have to
work within. By introducing and acting upon this
resolution #17-045 that was passed by
unanimous vote, the entire town board was
acting upon FAKE INFORMATION. When I returned from Puerto Rico, I
called you and told you about the petition
that I was
asked by Robert
Smith and several other Village residents to
make for them. They did not know how to make
one they said. People from the Village
always come into my store for help,
information, etc. about the Village or Town.
I guess it's because I am there and if they
call the Town Offices, the staff is not
always there. Most people need immediate
attention and I try to show respect for each
request that I may receive. I try to help in
any way that I can, but this is not in the
capacity of the Planning Board of the Town
of Saint Johnsville. It is simply because
the residents need information, help, or
attention right then. Sometimes I can help
or direct them to the proper channels. I do
what I can to help everyone. I would like to make this perfectly
clear: The petition that I made for these
Village residents was only for the purpose of
getting signatures to petition the Village of
Saint Johnsville Board to schedule a date for a
VOTE only, on the dissolving of the Village. The
petition does not mention the Town of Saint
Johnsville Planning Board at all and also it
does not mention my name in any capacity. How could I have been circulating a
petition when I was on vacation in Puerto Rico
for one month? How could you or the Town Board
have had a meeting about me or the planning
board with these false accusations without us
being present? This is very troubling to me
because the minutes of the Town Board are posted
on the Internet for all residents to read, and
for anyone to read that wishes to read them. In
all of my experience in business, I have never
had a supervisor, board of directors, town
board, or any other governing board have a
meeting based solely on gossip and false
information about me or anyone else. Most
governing bodies cheek out the information
BEFORE acting in this manner. When I talked with you, you said that
social media was involved in this matter. It's
very strange to me because I am on Facebook and
while I was on vacation, I had my tablet with me
and read Facebook every day. There was no
mention of me doing anything concerning the
Village the whole month. I do know that very,
very few people in the town or village use
Twitter, so WHAT social media are you talking
about? I am demanding that this FAKE
INFORMATION that you acted upon be rectified and

from the Public Michael Mancini Minutes from the April 6th
meeting were read and accepted. Jeff Hadcox made the
motion to accept, seconded by Les Larsen. Chairman’s report informing us of
the unacceptable garbage, rodents and trash being
accumulated by home next to the Dollar Store with
inactivity on the part of the Code Enforcement
Officer. Melanie Shuster made a motion
that the Code Enforcement Officer was to give us a
written report of his work each month, seconded by
Les Larsen. Under Old Business: Our Board
only opened up for discussion while the Chairman of
our Board was in San Juan Puerto Rico the
possibilities of a merger or cost effective ways of
saving money as suggested by the State. We are in
full knowledge that before this would take any form
it would have to go for a VOTE! We believe the Town Board has
been Misinformed of our intent, as any infractions
of our Chairperson makes all of us feel very
unappreciated of the time and effort we had put into
this Board. We are not having the support of the
Town Board. We also believe the Code Enforcement's
attitude of non compliance is no longer acceptable
to our Board. We have never had one meeting with him
since this new Board met over one and one half years
ago, nor has he given us any report of work during
that time. Under New Business: Since the
Code Enforcement Officer does not contact us there
is no new business. We also have seen evidence of
new buildings but have not received any permits. No Public Comments Jeff Hadcox made a motion to

Board - April 06, 2017 The meeting was called to order by
Vice Chairman George Haines at 7:00 pm. Present

Board member Les Larsen, Code Enforcement
Officer James Castrucci The minutes of the meeting of
March 2, 2017 were read. A motion to approve the
minutes by Jeff Hadcox, seconded by George
Haines. Under Old business: We have
not heard anything from Janet Shuster in regard
to the Sub Division of her property. We also had
a rather lengthy discussion on the Bumps and
Bruises of a Consolidation of the Village and
Town Government. The assets of the Village along
with the Debt would certainly have an input. The
asbestos in the Fowler Mill along with the other
Mills would certainly be a consideration Factor,
as we cannot increase the burden of additional
taxes on the residents of the Town Under new Business: There
seems to be nothing pending at this time. Since we had no one from the
Public we made a motion was made at 7:45 pm to

09 2017 The Meeting was called to
order at 7:00 pm. March 09 2017 Present Chairman Martha
Mancini, Vice Chairman George Haines, Jeff
Hadcox, Les Larsen, Secretary Melanie Shuster
absent Code Enforcement Officer James Castrucci.
From the Public Michael Mancini The Chairman reported on the
Town Board Meeting she attended on February 1611
suggesting to them that in order for the Town to
grow the Village and Town should merge saving
Tax Dollars as this would allow us to place
water and sewer in place to attract new
business. Several grocery chains have been in
touch with our Chairman Martha Mancini. The Town
Supervisor's opinion is that the Town would not
benefit and the Village only slightly. Two of
the Board members were positive about this, one
that would not comment, and one member absent. Chairman Mancini heard from
Cypress Creek Renewables about the Drinkwater
Project in trying to have National Grid come to
some kind of agreement, and also asking what
kind of formula the Town along with the County
Taxes might be on this project. They are just
trying to get an idea about how much funding
would be required in other areas in order to
help them with negotiations with National Grid. Upon checking with tax
assessor Ms. Leigh Ann Loucks, there is not
single Montgomery County Tax Assessor that knows
the formula even though there is a solar farm in
Nelliston. This month there will be a meeting on
the County Level in order to decide what the
formula will be. Under Old Business we were
informed that there had been a mix up and the
wrong date had been informed to us to attend the
State Meeting for all of our members. Hence none
of us attended the meeting. We also need to
revise our Land Use Laws for variance on Solar
Farms. In discussion on a Newsletter to be sent
out each month, this would be time consuming and
costly. Perhaps we can place the minutes in the
Pennysaver along with the Internet. Janet Shuster's application
for a Minor Sub Division was returned to her as
it was not filled out correctly Discussion again
on the Comprehensive Plan, Jeff Hadcox made a motion to

February 02, 2017 The meeting was called to
order by the Chairman Martha Mancini at 7 p.m.
Present at this meeting was Chairman Martha
Mancini, Vice Chairman George Haines, Secretary
Melanie Shuster, Jeff Hadcox, Les Larsen. Absent
Code Enforcement Officer, James Castrucci. From
the public, Michael Mancini, John Regan of
Cypress Creek Operational Sites Overview. Minutes of January 5th
meeting were read and approved. Motion to accept
by Melanie Shuster, seconded by George Haines. Chairman's Report: New York
State Department is offering a Training Course
on February 10th at Fulton Montgomery Community
College with each person receiving one credit
for completing the course. This is to start at 5
p.m. and last to 8:15 p.m. Discussion about the
Comprehensive Plan which must be updated every
five years. The last time it was updated was
March of 2005. Chairman Mancini thought the Plan
was a good one, but the Town Board was in charge
of implementing it and this never happened. The
Board felt it was not worth our time and effort
if this was to happen again. Under new business: Mr. John
Regan of Cypress Garden spoke to the Board that
Mr. Lottman's land was on hold as National
Grid's Power Station would not accommodate such
a large project, but hoped the problem might be
resolved in the future, as Cypress Garden
thought the price of power was excessive. The
Public Service Commission regulates the 25
megawatt project. At the present time we have
more than one large Food Chain inquiring about
large tracts of land for building which the Town
has available. They want water and sewer which
at the present time the Town is unable to
furnish. The Code Enforcement Officer
placed copies of (2) permits that he had issued
in December in the Planning Board Communication
Basket. We have asked him over and over to do
this just in case a resident asks the Board
about permits for various sites. Many residents
ask these questions when permits are not posted
and work is being done on several sites. There was no comments from
the Public. Motion to adjourn at 7:30 made by

BOARD -
The meeting was called to order at 7:00 pm by
Chairman Martha Mancini. Present at this meeting
was Chairman Martha Mancini, Vice Chairman
George Haines, Jeff Hadcock. Absent was
Secretary Melanie Shuster, Code Enforcement
Officer James Castrucci, and Les Larson. From
the public Michael Mancini.
The minutes of the last meeting were read and
approved. Motion made by George Haines, Seconded
by Jeff Hadcock.
Chairman's Report We have asked Cypress
Renewables for a copy of their soil run off
statement and were assured that we would have
that report by our February meeting. After the
February meeting, the final reports for the
Drinkwater Solar Project must be made and
readied to be sent to the Montgomery County
Planning Board for their consideration. Work has
been done on this special use permit, but since
part of our members have not been able to attend
our meetings, this caused a delay.
The poultry processing plant that was issued a
special use permit last year is no longer going
to be built. The people who were going to
operate this facility has decided not to build
it at this time due to a cash flow problem they
are having. They were informed that if, in the
future, a decision to build a poultry processing
plant, another special use permit would be
required and another fee would be paid.
The Code Enforcement Officer placed copies of
two (2) permits that he had issued in December
in the Planning Board Communication Basket. We
had asked him over and over to do this just in
case a resident asked the planning board about
permits for various sites. Many residents ask
these questions when permits are not posted and
work is being done at certain sites.
There was no old business. There was no new
business.
The public did not have any issues to bring up
to the planning board.
